TERMS OF SERVICE

By participating, purchasing a membership, or attending sessions, you (“Client”, “you”,“Participants”) acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions. It governs your use of services provided by GM pilateshape (“Studio”, “we”, “us”), a fitness studio operating in Hong Kong, including Electrical Muscle Stimulation (EMS), Pilates reformer classes, and other kind of classes (“Services”). Please read it carefully.

Orientation

New clients must complete a 30 minute mandatory intro Session(HKD280) for EMS safety, suit fitting and equipment use prior to their first session.

Membership and Class Packages

  • Memberships: All memberships are non-transferable and must be used by the member only.
  • Memberships may have specific terms regarding duration and usage.
  • Class Packages: Class packages have an expiration date, which will be specified at the time of purchase. Normally is 3 months. Unused classes will be forfeited after the expiration date.

Payment

  • All payments must be made in full at the time of booking. Accepted payment methods include cash, credit/debit cards, and other methods specified at checkout.
  • Late cancellations and no-show fees may apply as detailed in our Cancellation Policy

Health and Safety

  • Participants must disclose any medical conditions or injuries that may affect their ability to participate in classes or sessions.
  • The Studio reserves the right to refuse participation if a client poses a risk to themselves or others.

Cancellation Policy

Clients must provide at least 24 hours’ notice for cancellations. Late cancellations and no-shows will incur fees as outlined in our Cancellation Policy.

Studio Etiquette

  • Participants are encouraged to arrive at least 10 minutes before class starts. Late arrivals beyond may be denied entry, with session forfeiture at our discretion.
  • Non-slip socks and form-fitting athletic wear are mandatory for all classes.
  • Respect the studio, equipment, and other clients. Disruptive behaviour will not be tolerated.
  • Personal belongings are stored at your risk; lockers are provided but not insured against theft.
  • Damage to mats, reformers, or EMS units due to misuse incurs repair/replacement costs.
  • Verbal/physical aggression, harassment, or unauthorised filming triggers immediate ejection and a 30-day ban, escalating to permanent termination without refund.

Liability and Indemnification

  • Liability Waiver

    • By participating in classes and sessions, you acknowledge that there are inherent risks associated with physical activity. You agree to release the Studio from any liability for injuries or damages resulting from participation.

  • Liability Caps

    • General Limit: Our liability for any claim is capped at the total fees paid by you in the preceding [e.g., 3 months], excluding indirect damages (e.g., lost income).

    • Statutory Exception: Liability persists for gross negligence or wilful misconduct as defined by Hong Kong courts.

  • Equipment and Service Disclaimers

    • As-Is Provision: EMS machines, Pilates reformers, and facilities are maintained diligently but provided without warranties beyond manufacturer guarantees.

    • Malfunction Response: Equipment downtime triggers class rescheduling or credits, not cash refunds, unless persistent (e.g., >[3 days]).

  • Client Indemnity

    • You indemnify us against claims arising from:

      • Undisclosed health risks causing injury to self/others.
      • Misuse of equipment or facilities.
      • Breach of these terms leading to third-party harm (e.g., disrupting a class).

Intellectual Property and Media

  • Proprietary Rights

    • Protected Assets: Class choreography, EMS training protocols, all branding, and digital content are owned by the Studio, under copyright and trademark law.
    • Usage Restrictions: Recording, replicating, or distributing these assets without written consent incurs a USD9,999 penalty per incident, plus legal costs.

  • Media Consent

    • Default Permission: Participation implies consent for us to capture and use your image/voice in promotional materials (e.g., Instagram, flyers).
    • Opt-Out Process: Submit a signed opt-out form to [insert email] within [e.g., 7 days] of membership start or annually; retroactive removal is not guaranteed if media is already published.

Changes to Services

The Studio reserves the right to modify or cancel classes, instructors, or schedules as necessary. Clients will be notified of any significant changes.

Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising from these terms shall be resolved in the appropriate courts of Hong Kong.

Amendments

The Studio reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.
